The Regulations on Civilized Sacrifice of Jilin City (referred to as the Regulations) have been deliberated and passed at the fifth meeting of the Standing Committee of the 17th People's Congress of Jilin City on September 20, 2022，Approved at the 37th meeting of the Standing Committee of the 13th People's Congress of Jilin Province on November 30, 2022，Effective January 1, 2023。

Since the 18th National Congress of the CPC, the CPC Central Committee and The State Council have placed the construction of ecological civilization in a prominent position and coordinated it into the overall layout of the "five-in-one"。The report of the 20th National Congress of the Communist Party of China pointed out that it is necessary to implement a comprehensive conservation strategy, advocate green consumption, and promote the formation of green and low-carbon production methods and lifestyles。In recent years, our city has continued to strengthen the management of civilized sacrifice, and initially established a working mechanism of government-led, civil affairs led, and joint law enforcement by departments, which has achieved certain social effects。However, in the Qingming Festival, Hungry Ghost Festival and other key time nodes, there is still the phenomenon of manufacturing, selling, burning feudal superstitious sacrificial products, which seriously affects the appearance of the city and the health environment, and there is also a huge security risk。At the same time, the management of sacrifices is mainly based on the "Regulations on Funeral Management of The State Council" (1997), which is difficult to operate because of a long time ago。To this end, under the great attention of the city leaders, the Regulations will be included in the 2022 legislative plan。

The "Regulations" is a local law and regulations formulated in conjunction with the actual management of civilized sacrifice in our city, marking the management of civilized sacrifice in our city has entered a new stage of legalization and standardization。The implementation of the "Regulations" will play an important role in promoting the management level of civilized sacrifice in Jilin City, breaking the bad customs of sacrifice, guiding the general public to enhance the consciousness of environmental protection, and consolidating the creation of civilized cities。

The provisions on the manufacture of sacrificial articles shall apply to the urban areas of this municipality;

The administration of sacrificial articles and sacrificial activities shall apply to the built-up areas of this Municipality。

Q: What are the sacrificial articles of feudal superstition in the Regulations？

The "feudal superstitious sacrificial articles" mentioned in the "Regulations" refer to the dead paper, dead coins, paper money, paper people, paper cows, paper horses, as well as imitation gold and silver ingots, all kinds of housing, transportation, daily necessities, documents and other articles used for sacrificial activities。

Q: What sacrificial acts are advocated in the Regulations？

The Regulations advocate the following civilized sacrificial acts:

(1) Offering sacrifices through established public and civilized sacrificial places, as well as sacrificial facilities and network platforms set up by cemeteries and funeral service institutions;

(2) Using reusable and degradable sacrificial articles to perform sacrifices;

(3) Offering sacrifices in the form of flowers, music, tree planting, etc.;

(4) Other safe, frugal and green civilized sacrificial acts。

Q: What sacrificial acts are prohibited under the Regulations？

The Regulations prohibit the following acts of sacrifice and other related activities that are harmful to the ecological environment and resource protection, harmful to others and public order, and promote feudal superstition:

(1) Manufacturing, selling, transporting and burning articles for feudal superstitions and sacrifices;

(2) Setting up a funeral shed or placing wreaths, flower baskets, elegiac couplets (curtains) and other sacrificial articles in public places;    

(3) Throwing paper money, bridge paper;

(4) Other uncivilized sacrificial acts prescribed by laws and regulations。

Q: How to punish the manufacture and sale of feudal superstitious sacrificial articles？

The civil affairs department, together with the market supervision and administration department, shall order it to stop its illegal acts, confiscate its manufacturing equipment and feudal superstitious sacrificial articles, and may concurrently impose a fine of not less than one time but not more than three times the amount of the manufacturing and sales。

Q: How to punish the sale and burning of sacrificial articles？

The urban administrative law enforcement department shall order the cessation of the illegal act and impose a fine of not less than 500 yuan but not more than 1,000 yuan。Whoever burns the articles of feudal superstition for sacrificial rites shall be ordered by the administrative law enforcement department of the city to make corrections; whoever refuses to make corrections shall be fined 100 yuan。  

Q: How to punish sacrificial acts such as setting up a funeral shed and throwing paper money？

Where a funeral house is erected or a wreath, flower basket, elegy (celebratory) or other sacrificial articles are placed in a public place other than an urban road, square, public green space, residential area, or other funeral service unit, the urban administrative law enforcement department shall stop it and order it to make corrections, and whoever refuses to make corrections shall be fined 100 yuan。Those who scatter paper money or bridge paper shall be ordered by the urban administrative law enforcement department to make corrections; those who refuse to make corrections shall be fined 100 yuan;Whoever throws paper money while driving a motor vehicle shall be punished by the public security organ in accordance with the relevant provisions of the Road Traffic Safety Law of the People's Republic of China。
